Updates in the UK visa 2019

The government of UK has made various changes in the visa and immigration processes which will be implemented in October 2019. Out of all the changes, the major ones have been done in the Tier 2 which is the General visa category, the Tier 1 Exceptional visa route and in the UK startup and innovator visa policies. Changes have also been made in the Tier 4 for the international students who will now be allowed to stay in UK for a period of two years after the completion of their course. The details of this scheme are yet to come completely.

The changes in the Tier2 visa scheme has helped a lot of many employers and the UK visa migrants. The system of the UK has gone much easier and relaxed with all these new updates. However, not all changes have brought ease to the people. Some of them have also brought difficulty. All these changes have been done in relation to the situation of Brexit.

There are a lot of point in details related to the Tier 2 scheme. They are given as follows:
  • The new scheme welcomes employees for various industries. The Migration Advisory Committee has published a new list known as SOL which displays the shortage of the occupation in the nation. As per this scheme, more and new occupations are to be added which will increase the number of people and mushroom employment in UK.
  • The salary rates of SOC have also been modified and will be applied to the CoS that is the Certificate of Sponsorship.
  • The occupations at the PhD level will also be exempted. They will no longer be required to have a CoS. By doing this, the vacancies of other skilled roles (that contribute more to the economy of UK) will be freed up.
  • The rules pertaining to the licensed sponsors with digital technology qualifying status providing jobs in digital technology SOC will now be more flexible and relaxed.
  • Applicants applying for the English language tests will no longer be asked to have a paper test certificate. Their unique reference number is sufficient enough.
  • Migrants falling under Tier2 category who are absent from work owing to their illness, parental leave, aiding in a national, global or humanitarian crisis would no longer be penalized. Thus, in case of an absence the migrants will not be refused their ILR.
  • The administrative reviews which is a mechanism to challenge the decisions has to be now submitted in an online way in case the original application was not made on a valid paper form.
  • The employees associated in PhD level SoC codes will no longer have their absences counted in the indefinite leave to remain absence rules which means migrants who have been granted leave must not exceed 180 days’ absence.
The details of the EU settlement scheme as per the Brexit scenario have been given as follows in detail:
  • The non-EEA family members of the EEA citizens who have been given EUSS status will be now allowed to apply a EUSS travel permit that too free of cost in case their biometric card is lost or stolen. This will be applicable in the coming months.
  • People whose UK immigration status have been revoked at the border by an immigration officer due to any reason will now be granted to an administrative review.
  • Changes will also allow the close family members of UK citizens who had been earlier living with UK overseas to apply to remain in the UK under the EUSS till March 2022. This change is applicable in both the situations, a deal or no deal Brexit case.
  • A lot of technical changes have also been made to the EU Settlement Scheme rules that is EUSS specifically for the family members of the nations of UK who are returning from a European Economic area Member State or Switzerland. A lot of changes appear to render clarity.
Details of the Tier 1 visa scheme as of the Brexit situation have been given below:
  • The list in relation to the peer reviewed fellowships will be broadened to incorporate more fellowships as granted by the National institute for Health Research.
  • Also, expansion of the criteria to allow a greater number of senior academic or research positions to qualify will now be granted in UK.
